The Apple Watch ban is set to be appealed as it goes into full motion

A few weeks ago, the ITC issued the Apple Watch ban on the newer entries, a decision which could be reversed by the White House. Apple was hoping that the White House would reverse this ban, hence bringing their products back on sale, but that didn’t happen. Now, Apple is appealing this case and the decision by the ITC to court to get a fair hearing and hopefully lift the ban on the Series 9 and Watch Ultra 2.

You might be wondering why the White House didn’t reverse the ruling of the ITC on this case. According to Katherine Tai, the United States Trade Representative Ambassador, this decision is a result of “careful consultations.” Meaning that the White House under Biden’s Administration was able to look into the details of this case and is standing with the ITC’s decision.

This decision by the ITC and the White House isn’t in favour of Apple or its business. For this reason, the tech giant is taking legal steps to see that they get this ban off their new products. These legal steps will include an official appeal for a second look into this case.

This case between Apple and Masimo will appear before the US Customs and Border Protection (CBP) organization in a few days. The organization will decide on whether the Apple Watch 9 and Watch Ultra 2 can go back on sale. Apple will take this hearing that’s to take place on January 12 as another window to shake this ban off their products.

However, the ruling of this case can only permit redesigned versions of the Apple Watch 9 and Watch Ultra 2 to go on sale. These versions will have to drop off the health feature that Masimo claims ownership over. In a few days, we’ll get to know whether Apple will start rolling out redesigned versions of their latest watches.
